A juicio del peticionario se vulneró el debido proceso, al no poder controvertir la accionada las pruebas solicitadas de oficio por la Sala de Revisión y porque se cambió la jurisprudencia de la Corporación.
La Sala Plena DENIEGA la solicitud de nulidad invocada, al comprobar que la Sala de Revisión, al adoptar la sentencia T-440A/09 no se apartó de precedente jurisprudencial alguno, ni vulneró el debido proceso alegado.
